Trademark search

There are two different searches type

(1)	Internal search, this service is free of charge and only take 2 hours (just for reference)
(2)	Official government search, the result is only base on the trademark record, and it is only for reference not guarantee. It takes around 7 working days

Although the trademark search result does not guarantee examination result, but it already greatly reduced the risk for the registration, we strongly suggest you to do the search before their application.

Trademark search introduction

Take trademark registration in China as an example, the registration takes around 24-36 months. If the application was rejected, the company not suffers from losing the registration fee, but also the time cost spent on waiting the application result and potential time cost for making another application. Even making another application also takes the same duration of time and there is also no guarantee for the application result.

We suggest applicants can consider their own situation to decide whether to take the trademark search in order to increase chance for the registration approval.

Trademark Renewal

Explanation:

Client should apply for renewal within 6 months before the termination of the trademark registration. If client failed to submission the application, there will still be 6-month reserved registration, after this period, the registration will terminate.

Please take care of the expired date of your registration and start your renewal on time (If renewal application submitted in the reserved registration period, the Trademark Office may charge for extra delayed fee). Failing to renewal your registration will lead to potential risk of losing existing market and you.

Basic Introduction

	Registered trademark owner should update the Trademark Office their updated information if any of the registration information is changed
	Applicant can change their application information with the registration period, including changing ownership name, address, registration agency or reduce registration class.
	If there is any change of the corporate applicant, such as merger, combination, and lead to transfer of trademark ownership, they should update the Trademark Office immediately
	Changing Trademark Ownership name does not transfer of trademark ownership

Application process

Required documents:

(1)	Application for change registration information
(2)	Applicant Identity documents copy
(3)	If change ownership name, related document prove is also required
(4)	If those documents are foreign language, it should submit with a translated document

Important Notes

1.	Applicant should submit an application for each of their trademark.
2.	The Trademark Office will issue an application notice by mail once they receive your application
3.	If the Trademark Office requires for any document, the will send you a document checklist by mail
4.	If the application is approved, the Trademark Office will issue a certificate
5.	If the application is reject by any reason, the Trademark Office will send you the rejection notice by mail
6.	All certificate and documents will only send to the registration representative, even if the trademark is co-owned by two parties. If extra certificate is needed, you have to ask for re-issue of them
7.	If applicant appointed a registration agency, the Trademark Office will send all the mail to the agency and will not have any direct contact with applicant
8.	Applicant Form should follow the Certificate of Registered Trademark detail

Transfer of Ownership of Trademark

Basic Introduction

	The transferor and transferee should submit the application together
	If corporate combination, merger or demerger and lead to a transfer of trademark ownership, corporate should send the transfer of trademark ownership to the Trademark Office as soon as possible
	Trademark will automatically deregister if its owner corporate deregister, no extra deregistration application has to be submitted
	If transferee holding another similar trademark in the same class, the two trademark should combine together
	Both transferor and transferee will receive transfer notice and certificate once the application is approved by the Trademark Office

Required Documents

Please prepare the following documents

1.	Transfer of Trademark Ownership application and Registration Agency Appointment Letter
2.	Transferee Identity documents
3.	Special documents required:
	1)	If the trademark is for medicine, health food or baby food, the transferee should provide their company had related approval for operation those product trading
	2)	If the trademark is for tobacco product, it had to be approved by government
	3)	If ownership transfer due to corporate owner merger, demerger or combination and the previous identity no longer exist, they have to provide related document issue by the commercial department

Important Notes

If transferor has similar trademark for related product, they have to transfer them to the transferee as well. If they allowed others to use the trademark, they have to get the permit of those candidates for the ownership transfer.
